Federal law and all 50 states make it illegal to create, sell, distribute, or possess child pornography that depicts actual minors engaging in sexual conduct. Many of these laws extend to images created, adapted, or modified to depict an identifiable minor, which arguably includes deepfakes and AI-generated images.

Deepfake's legal standing is tricky and changing. This harmful content is not intrinsically outlawed but can breach the law. This is especially true if they infringe on privacy, intellectual property, or involve defamation, harassment, or fraud. The tricky part is that current laws weren't made with deepfakes in mind.

Most likely, under California law, you could not be charged for ownership or marketing of cartoon child pornography. Prosecutors can convict you on the grounds that you were aware you participated in child pornography (meaning creation, ownership, or distribution), and if you were aware that the victim was a minor.

If a deepfake falsely represents an individual in a defamatory manner, existing defamation laws can offer some recourse.

Keep in mind that free versions may have limitations or may include watermarks on the output videos.
